1. Acceptance of Terms

By purchasing, receiving, or using the NoCastBat training bat (“Product”), you agree to these Terms and Conditions. Please read carefully before use. If you do not agree, do not use the Product and return it in unused condition within 30 days of purchase for a refund (see Section 6).

2. Intended Use

The NoCastBat is a baseball/softball training aid designed to help players develop proper hitting mechanics. It is not a certified game bat and should not be used in live game play. The Product is intended for training purposes only, under proper supervision when applicable.  Only balls listed are to be used with NoCastBat (NoCastBat Balls, Jugs Lite Flight, Tennis balls, any training ball made from rubber/plastic under 46 grams in weight, whiffle balls).  NoCastBat is not to be used to hit rocks, acorns, dirt rocks, ball bearings, etc.

3. Assumption of Risk

By using the NoCastBat, you acknowledge and agree to the following:

  • Inherent Risks: Baseball and softball training involve inherent risks, including but not limited to being struck by a ball, bat, or other equipment; muscle strain; or other physical injury.
  • Voluntary Participation: You are voluntarily choosing to use the Product, with full knowledge of these risks.
  • Responsibility: You assume full responsibility for your use of the Product, including ensuring that you are in good physical condition to train, that the environment is safe, and that the Product is used as intended.
  • Release of Liability: JC Bats, LLC and its owners, affiliates, partners, and distributors shall not be held liable for any injury, damage, or loss arising from the use or misuse of the Product. By using the Product, you release JC Bats, LLC from any and all claims to the fullest extent permitted by law.  JC Bats, LLC and its owners shall not be liable for any punitive or exemplary damages. 

4. Safety Guidelines

To reduce the risk of injury:

  • Always warm up properly before training.
  • Use the Product only in safe, open training environments.
  • Do not strike hard balls, rocks, or foreign objects. Use with approved training balls only. (NoCastBat Balls, Jugs Lite Flight, Tennis balls, any training ball made from rubber/plastic under 46 grams in weight, whiffle balls).
  • Children under 18 should use the Product only under adult supervision.
  • Inspect the Product regularly for damage. Do not use if cracked, broken, or otherwise compromised.

5. Warranty Disclaimer

The NoCastBat is sold “as is” without express or implied warranties of any kind, including warranties of merchantability or fitness for a particular purpose. JC Bats, LLC does not warrant that the Product will prevent injury or guarantee performance improvement.

6. Returns & Refunds

Unused Products in original condition may be returned within 30 days of purchase with proof of receipt. Shipping costs are non-refundable. Custom or modified Products are final sale.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.
